Buckley v Accident Compensation Corporation
- Citation
- [2003] NZACC 121
- Court
- District Court
The respondent's determination that the appellant had a capacity for work was quashed because the occupational assessment was wholly unacceptable—it failed to properly evaluate the appellant's severe dyslexia, low literacy and lack of transferable skills—and the medical assessment was insufficiently persuasive in relation to certain jobs; accordingly the appellant's weekly compensation was reinstated.
