The Court found that because of significant post‑settlement changed circumstances (notably the Canterbury earthquakes) and insufficient income to achieve the settlor's educational horticulture purpose, carrying out the original income‑only scheme was inexpedient; the proposed capital payments and structure were charitable and, as closely as reasonably possible, reflected the settlor's intentions, the Attorney‑General supported the scheme, and therefore approval under the Charitable Trusts Act 1957 was granted.
