The Court held that the 2000 additional guidelines remained part of the framework supplementing the 2001 criteria, that the guidelines and the revised criteria cohered and were not irrational, arbitrary or unworkable, that Ms McDonald QC applied the combined criteria correctly, and that New Zealand's reservation to Article 14(6) ICCPR precluded any domestic duty to apply that Article; accordingly the plaintiffs' declaratory and compulsory relief failed and judgment was entered for the Attorney-General.
