The 2001 Deed was ineffective, the Deed of confirmation regularised trusteeship, the second respondent consented, and the first respondent was proven mentally incapable so that s 52(1)(b)(i) was satisfied; accordingly a vesting order and ancillary orders (including dispensing with service and not appointing a litigation guardian) were appropriate.
