The court found the jurisdictional facts established and, applying s37 and relevant authorities, determined no persuasive discretionary reason existed to refuse adjudication: the debtor had no significant assets, no evidence that creditor conduct caused material prejudice to repayment prospects, and the public interest and accountability favoured adjudication; accordingly the debtor was adjudicated bankrupt and ordered to pay costs on a 2B basis plus disbursements.
