Wild J was correct that his decision was made under s61A(3) as it was a review of the Registrar's decision; s61A(2) confers Court of Appeal review only for orders made under s61A(1), so the Court of Appeal had no jurisdiction to review the decision and leave to appeal is refused because no general or public importance or risk of substantial miscarriage of justice was shown.
