Leave to appeal was refused because the applicants failed to demonstrate any seriously arguable error of law; the Tribunal's adverse credibility findings and factual assessments were supported by evidence and country material, and the peripheral challenges and additional evidence did not show errors of fact so grave as to amount to errors of law under s245.

Leave to appeal was dismissed because the proposed appeal had no prospect of success: the Court of Appeal correctly held there is no recognised common‑law right to family life in New Zealand for these purposes, no breach of s 9 or s 17 of the Bill of Rights Act, the claim was time‑barred under s 247(1) of the Immigration Act 2009, and decisions to refuse boarding are rendered non‑reviewable by s 97(4) except as provided in s 97(3)(b), so striking out the claim was clearly justified.

The District Court held that the 9 March 1999 letter did not operate as a new decision; however the form signed on behalf of the appellant on 30 January 1999 amounted to a written indication of non-acceptance and should be treated as an application for review, therefore the review was not out of time and the file must be referred back for a review hearing.
