    The application for leave to appeal is dismissed because the Court of Appeal lacks jurisdiction under s 95(2)(b) of the Weathertight Homes Resolution Services Act 2006 to hear a further appeal from a High Court determination on a Weathertight Homes claim; alternatively, applying s 67(2) of the Judicature Act 1908, no question of law or fact capable of bona fide and serious argument of sufficient importance was identified and leave would be refused; accordingly leave is dismissed and costs are awarded to the respondents.
