The Court refused to strike out the s26 prayer: adding a s26 recommendation at this stage was not an abuse of process where no close of pleadings had been fixed and s26 contains no temporal limit; relief under s26 can be sought against persons who supplied defamatory material to a publisher such that their liability arises from the republication; defendants retain the option to apply for trial by judge with a jury under s19B(2).
