The High Court (pursuant to s39 of the Property (Relationships) Act and r20.19 of the High Court Rules 2016) may, after hearing counsel in chambers, make consent orders on appeal without a full hearing where satisfied the proposed consent orders are just and fair; applying that principle the Court made the agreed consent orders including release of specified Kiwisaver funds and division and payment directions between the parties.
