Summary judgment against trustees was dismissed because plaintiffs raised a tenable, novel argument that extreme parental abuse and resultant vulnerability could support a continuing fiduciary duty preventing deliberate inter vivos dispositions to defeat children's claims; summary judgment for solicitors was entered because no evidence established they knew or should have known of the abuse or that the settlor acted in breach of fiduciary duties.
