The trial Judge's factual findings that the appellant had knowledge of and control over the methamphetamine were open on the evidence, the presumption of supply applied to the 167.1 gram quantity and was not rebutted, and no error in assessment created a real risk of an altered outcome; appeal dismissed.

The High Court held that the appellant's comment to police, combined with the machete's immediate proximity and his attempt to prevent the search, supported findings of knowledge and assumption of control such that the machete was 'with' him under s 202A(4)(a); therefore the conviction was upheld and no miscarriage of justice occurred.

The application for leave to appeal is dismissed because although the trial judge's direction on wilful blindness was inadequate and a hearsay email was admitted, those errors did not produce a miscarriage of justice given the overwhelming evidence of actual knowledge and extensive properly admitted intercepted communications; therefore the test in s 13 Supreme Court Act 2003 is not met.
