The respondent's conduct in lodging and persisting with the notice of claim was an abuse of process and designed to cause maximum disruption to the trust's property transactions, falling within the categories in r14.6(4)(a) and the principles in Bradbury; accordingly the applicants are entitled to indemnity costs and disbursements claimed, while the respondent is entitled to 2B costs for the 2 June 2022 hearing quantified at $2,390.00.
