Leave was refused because the factual issues about the 2012 unregistered transactions did not raise matters of law of general or public importance and did not show the respondent's mortgage had been defeated; the attorney's notice was properly attributable and the deed of priority remained effective.

The land had long ceased to be customary land, was converted through historic Native Lands Court proceedings and Crown acquisition, and was lawfully transferred pursuant to the Te Roroa Claims Settlement Act into registered title; registration under the Land Transfer Act gives the plaintiff an indefeasible title not subject to the defendants' customary claims, and no triable exception (in personam or fraud) or statutory basis to impeach title was shown, so summary judgment for possession and striking out of counterclaim were warranted.
