The court concluded that although s116(5) effects vesting as a matter of law, it was appropriate to vary the earlier orders under r11.10 to correct the trust name and to include an express s116 vesting order identifying the property by title (45 Hunt Street, Dunedin OT201/253) to satisfy LINZ registration requirements, and approved the amended draft orders for sealing.
