The court found that on the balance of probabilities the appellant suffered a neck injury in the 1980 rugby incident and that Professor Gillett's independent clinical findings and opinion that the C6/7 prolapse was consistent with that historical injury were sufficiently compelling to overcome the absence of contemporaneous GP notation; accordingly ACC's decision declining cover was quashed and cover granted for the C6/7 disc prolapse arising on or about 29 March 1980.
