The judge accepted the unchallenged and comprehensive medical opinion of Mr Pai that the appellant's L5-S1 degeneration was constitutional/degenerative and not the result of a specific accident, and found no contemporaneous medical evidence to establish causation on the balance of probabilities; therefore ACC was correct to decline cover.
