Wendco established a serious question to be tried that clause 46.3 may have been breached by blocking Lot A, but it is premature to grant the mandatory interim relief sought because effective relief would require dismantling the fence and constructing a roadway and the Court lacks sufficient evidence about the redevelopment's impact; accordingly urgent interim mandatory relief is declined and the parties were directed to file evidence for the scheduled defended hearing.
