The Court declined to order taxation by the Registrar, held that clause 10.1 of the lease provided a broad contractual indemnity entitling the lessor to indemnity costs properly incurred (including pre-commencement costs where within the clause), assessed the reasonableness of claimed costs against that contractual entitlement, deducted specified non-recoverable attendances (liaison with a second firm), found the remaining claimed costs reasonable, and awarded indemnity costs of $87,922.19 and disbursements of $1,626.08 while refusing an award for costs on costs.
