The bankruptcy notice was valid and any misdescription in the debtor's name was a correctable defect under s418; the applicant failed to establish remission or a genuine triable cross-claim equal to or exceeding the judgment debt that could not have been raised earlier, and the Trustee's adjudication application was premature, therefore the application to set aside the bankruptcy notice is dismissed and the adjudication application is dismissed as premature.
