The community detention (6 months), 18 months intensive supervision and 100 hours community work was upheld; appeal dismissed.

LYNCH v NEW ZEALAND POLICE [2022] NZHC 1448

The High Court held the District Court's starting point and uplift were within the permissible range but the sentencing Judge failed to allow an adequate discount for the appellant's deprived upbringing and addiction; admission of the section 27 material warranted a 20% discount for mitigation which rendered the original sentence manifestly excessive, and the appropriate remedy was to quash the sentence and substitute a reduced term of imprisonment of 26 months after recalculating discounts and uplift.

The Court held the District Court erred in adopting an eight month imprisonment starting point which was manifestly excessive for these facts; appropriate starting point was four months' imprisonment, with a 10% credit for the appellant's background and rehabilitation efforts, and, applying the principle of least restrictive outcome, the appropriate substituted sentence is 12 months' supervision plus 250 hours' community work with special conditions (no alcohol/illicit drugs, no contact with complainant or immediate family, attend drug/alcohol rehabilitation and complete SAFE programme).

The Judge correctly exercised sentencing discretion: the offending was premeditated, a targeted unanticipated blow to the head of a vulnerable victim causing unconsciousness and injury, and the need for denunciation and deterrence outweighed personal mitigating factors; therefore home detention would be 'much less than the least restrictive outcome' and the 18‑month imprisonment (after plea discount) was within range and must be upheld.

The starting point of three and a half years' imprisonment was within range given high culpability: calculated, sophisticated offending over a year targeting vulnerable victims, significant breaches of trust and prior dishonesty convictions (including offending on bail). The sentencing judge correctly applied Varjan factors, appropriately discounted for remorse and guilty plea, and there was no less restrictive sentence reasonably available; appeal dismissed.

The appeal is dismissed because the sentencing Judge did not err in law or principle in refusing to convert the short-term prison sentence to home detention: she made a reasoned, principled evaluative judgment that, given the offender's significant history of non-compliance and offending while subject to electronic monitoring and other court orders, only a short custodial sentence would adequately serve the relevant sentencing purposes and be the least restrictive appropriate outcome.
