There is no real risk of a substantial miscarriage of justice; the Secretary reasonably concluded the applicant did not have the requisite recent criminal experience or up-to-date knowledge (including of the Criminal Procedure Act 2011) and was entitled to decline to exercise the exception in reg 6(5); AQ was distinguishable on its facts, so leave to appeal is dismissed.
