The High Court had jurisdiction to hear the appeal under s143(1)(c) because the Family Court's refusal of leave finally determined the proceedings; leave to appeal out of time was granted; on the merits the Family Court correctly refused leave under s47(1)(e) because the appellant failed to show an appropriate and sustainable interest and an arguable case that contact would be in the child's best interests, and there was real risk of emotional harm to the child given he did not know of his adoption and the appellant's inconsistent prior engagement.
