Leave under s88(2) was properly granted because refusing leave would cause a serious injustice: the deceased's estate had relationship property (family home and substantial joint account funds at death) sufficient to meet both a meritorious Family Protection Act claim by the daughter and adequate provision for the widow, and denial of leave would prevent an otherwise meritorious claim from having assets to enforce against.
