The Court held that a spouse's expectancy as a discretionary beneficiary of a family trust constitutes a 'resource' for legal aid means assessment under Schedule 1 cl 4 and that reg 8(4) of the Legal Services Regulations 2006 is sufficiently broad to permit the Agency to treat trust assets as the applicant's resources via the spouse; accordingly the Panel did not err in law and its confirmation of the Agency's decision was not manifestly unreasonable.
