On inspection the emails constituted confidential legal advice directed jointly to Messrs Manhaas (in his capacity as director of the defendants) and Bir Singh; that advice attracted legal adviser privilege and was jointly held under joint interest privilege (Evidence Act s66), so disclosure to Singh did not waive privilege; no successful s67 dishonest purpose exception was established or properly argued, therefore the application to set aside privilege was dismissed.
