The Court exercised its power under s 74 to settle the proposed scheme because it was satisfied the scheme was necessary to enable essential remedial works, would benefit both the body corporate and individual proprietors by ensuring consistent standards and a single contracting arrangement, and service issues had been appropriately addressed by dispensing with service on one owner and authorising substituted service for others.
