The Court dismissed the application for personal costs because the solicitor's errors were at most minor and did not amount to the serious dereliction or gross negligence required to justify personal costs; commencing proceedings to preserve limitation and deferring steps pending Family Court resolution were reasonable; procedural non-compliance did not void the proceedings and privileged settlement communications could not be used to show impecuniosity.
