Costs awarded to the Ministry on a Category 2, Band B basis ($6,690) with disbursements of $413.50; no uplift to scale was warranted because although the applicant's arguments failed they were not so obviously lacking in merit or so unreasonable as to justify increased costs under r14.6(3).
