The 22 May 2000 decision letter was, when objectively construed, an unambiguous primary decision that the debt would not be remitted and informed the appellant of a strict three month review period under the Accident Insurance Act 1998; accordingly the review application filed on 3 February 2003 was out of time and must be dismissed, and the discretionary late-filing relief under the 2001 Act does not apply to this decision.
