Osborne v Accident Rehabilitation and Compensation Insurance Corporation

- Court
- District Court
On an overall view of the evidence, and particularly the orthopaedic opinion of Mr Fitzpatrick that the shoulder, forearm and carpal tunnel symptoms were related to an occupational overuse syndrome, the District Court concluded there was a causal connection between the appellant's work and her ongoing right elbow/forearm pain; absent a definitive diagnosis did not defeat compensability and the respondent's and review officer's decisions declining cover were set aside.
