Applicants, although former liquidators entitled to apply under s329, were not entitled as of right to use r19.4 originating application procedure; the Court exercised its discretion under r19.5 to permit originating application because there was no opposition and it was in the interests of justice, and on the merits the company should be restored and the liquidators' final report revoked to enable statutory reporting by the mortgagee.
