Transitional claimants described in s441 must be assessed under the 1998 Act as modified by ss441 and 442; where the claimant received a prior lump sum s442 applies and prescribes the commencement date of the independence allowance as the date of application for the allowance; therefore the pre-1998 1992 Act starting-date rule is displaced for such transitional claims and s442 is not limited to post-1999 new impairments.
