The Court accepted that intensive supervision could lawfully have been imposed at sentencing and that the defendant's continuing serious medical needs justified cancelling the remaining term of home detention and substituting intensive supervision until the original expiry date, with specified special conditions to address rehabilitation and health needs.

The appeal was dismissed because evidence established the prison provided reasonably necessary medical care and complied with statutory referral processes, the mothers' and babies unit placement had been approved, and there was no error of principle or manifest excess in the original sentence such as to justify additional mitigation beyond what the sentencing Judge had already allowed.

The High Court concluded the District Court's starting point of three years was within range but removed an uplift for prior NZ convictions to avoid potential double counting and applied a 15% reduction for serious medical/humanitarian grounds plus the 20% guilty plea credit, producing a two year imprisonment equivalent which the Court then commuted to nine months home detention as appropriate and available given current medical evidence and absence of remaining interpersonal concerns.
