Court preferred the treating surgeons' and specialist's causal analysis (Flint and Mercer) over the Corporation's medical adviser, finding on balance that the left inguinal hernia was traumatic and resulted from the 27 May 2010 accident; therefore the Corporation's decision denying cover was set aside and cover was granted.

On the balance of probabilities the Court preferred the treating orthopaedic surgeon's (Mr Rietveld) opinion that the appellant suffered an acute anterior impingement sufficient to tear the acetabular labrum during the pole exercise; accordingly the ACC decision revoking cover was unlawful and is set aside, with cover extended to include the small anterior superior tear of the right acetabular labrum.

On the balance of probabilities the medical evidence established that the appellant's lumbar condition was degenerative and had become symptomatic after the 24 June 2007 sprain (justifying suspension of entitlements), and there was insufficient positive evidence that the 22 June 2008 fall caused any new physical injury to justify weekly compensation; therefore both respondent decisions were correct and are confirmed.
