The Court concluded that because the Supreme Court found the original seven‑year sentence to be disproportionately severe in breach of s9 of the Bill of Rights, the appropriate resentencing under ordinary principles is six months' imprisonment to confer immediate liberty; mental health treatment needs are recognised but no compulsory inpatient order under s34(1)(b)(i) was made at this hearing.
