The defendant unreasonably failed to accept multiple without-prejudice save as to costs offers that were more beneficial than the eventual judgment; his counter-offers were unrealistic and conditioned by inflated claims, so an uplift on scale costs is warranted. The Court exercised its discretion under rr 14.6 and 14.11 to award increased costs of $50,000 plus agreed disbursements and directed a refund of half a day of hearing fees.
