The court approved the proposed distribution under s66 because the deed of arrangement was in the best interests of the deceased's minor beneficiaries and other parties: it preserved and was likely to maximise estate value by vesting development company shares in a trust, fairly allocated shares taking into account possible relationship and family protection claims, provided equal treatment and protections for minors via individual trusts, and was consented to by the parties, thereby justifying departure from default Administration Act distribution.
