The Chapter 11 proceeding was recognised as a foreign main proceeding because objective, public factors demonstrated UCI Holdings' COMI was in the United States; accordingly the Court granted recognition and modified the automatic stay under Article 20(2) so that it does not prevent actions authorised by the US Bankruptcy Court or United States bankruptcy law.
