A costs order under s364 CPA is appropriate due to repeated and serious police disclosure failings that materially delayed and compromised trial proceedings; on balance the responsible prosecuting agency (New Zealand Police) bears practical responsibility and must pay a punitive/deterrent amount of NZD 75,000 less sums already paid for accommodation and travel, payable in favour of the defendant to reduce his Legal Services Agency debt; the Crown Solicitor is not personally liable and leave is reserved for the defendant's wife to seek limited additional reimbursement.
