An objective reading of the emails of 8 and 9 September 2014, in the factual context of prior correspondence and dispute over delays, established a sufficiently arguable agreement that Gregory's liability for rent commenced on 1 September 2014; that created a genuine and substantial dispute as to whether the debt claimed by the statutory demand was owing, and therefore the statutory demand had to be set aside.
