The application for security for costs was refused because the judge was not satisfied there was reason to believe the plaintiff would be unable to meet an adverse costs award; having assessed the merits and circumstances (bona fide claim with prospects of success, some novel legal issues, plaintiff's ongoing income and history of meeting prior costs awards) it would not be just to order security.
