The applicant established a reasonably arguable constructive trust interest based on the 1961 deeded £200 contribution and subsequent payments (rates) which could be traced to later property acquisitions; there is an arguable basis to infer respondent had notice (same solicitor acted); accordingly the caveat should stand on an interim basis but the Court ordered security in the form of an undertaking that $120,000 of net sale proceeds be paid to the Registrar to protect the applicant pending substantive proceedings and listed the matter for review and directions to file by set date.
