The application to recall was refused because the judge, having reserved decision and reviewed the evidence, concluded that the executors' failures had caused an understandable loss of confidence such that they could not remain executors and replacement was justified; that conclusion rendered recall unnecessary.

The Court has jurisdiction under s 7 of the Administration Act 1969 to appoint a temporary administrator where proceedings for obtaining a grant of administration are pending; that jurisdictional requirement was met here, so the applicant was appointed temporary administrator and ordered to notify the residuary beneficiaries named in the 24 May 2011 will of the caveat; leave was reserved for further orders under s 7.

The letter dated 25 August 2011 was declared a valid codicil because it had clear testamentary effect, was signed by the deceased, the circumstances (including solicitor inability to attend) explain non‑compliance with formalities, and evidence established the deceased's intention and testamentary capacity to the civil standard required by s14 Wills Act 2007.
