MacKenzie J held that item 2 of Schedule 3 was the closer analogy to Petrobras's preparatory work despite only filing a notice of appearance and therefore allowed the item 2 claim; memoranda were allowable by analogy to item 4.10 including joint memoranda entitling each respondent to costs; the amended statement of defence was claimable under item 3.6 as a proper pleading responsive to further particulars; and disbursements (including the photocopying claim) are to be fixed by the Registrar in accordance with the trial judge's direction.
