The factual prerequisites of s 309(1)(b) were satisfied: the bankrupt paid amounts sufficient to discharge the sole creditor's debt and to cover the Official Assignee's fees and costs, procedural requirements under r 24.37 were met, the Assignee supported annulment, and therefore the Court annulled the adjudication.
