The application to suspend adjudication was dismissed because the appellant's proposed appeal was not bona fide and had no reasonable prospect of success, the debtor had committed an act of bankruptcy by not complying with the bankruptcy notice, and the balance of convenience and public interest in prompt Official Assignee investigations favoured refusal of a stay.

The Official Assignee failed to establish, on the evidence, the essential matters (control of entities and retention of beneficial assets) necessary to justify extension; circumstantial inferences were displaced by direct witness evidence; no unmanageable risk to the business community was proved; therefore immediate discharge was ordered and further extension was unjustified.

The Court exercised its discretion to dismiss the application for adjudication because the debts were minor, the debtor's difficult personal circumstances, and bankruptcy would produce little or no dividend and offer no sufficient justification for Official Assignee inquiries.
