The pleaded claim as filed was vague, speculative and disclosed no reasonably arguable cause of action in its present form and amounted to an abuse of process, but because some aspects might be cureable by amendment the Court declined to strike out and instead stayed the proceedings and ordered the applicant to file an amended statement of claim within a defined period; respondent entitled to seek costs.
