Contemporaneous emails and conduct did not support a reasonably arguable defence that repayment was conditional on the Wanaka subdivision; absent a concluded conditional agreement the loan was repayable on demand, reasonable notice had been given after formal demand, and therefore summary judgment for the respondents was correctly granted.
