The High Court refused leave to appeal because the proposed questions were either moot or not capable of bona fide and serious argument in the context of the arbitrator's factual findings and settled authority; the Joyner v Weeks principle and its application to landlord repair claims and the construction of the lease interest clauses were correctly applied such that further appeal was not justified under sch 2 cl 5(5).
